Purpose

Subscribing, registering and/or using the services of the said Site requires full and unconditional acceptance of these terms and conditions, which shall apply without prejudice to any specific or special conditions or agreements that may, where appropriate, be stipulated.

For the purposes of this agreement, the party subscribing to Inples’ services shall be referred to as the “Customer” or “User”, whether a natural or legal person.

Any person or entity who registers, enquires or enters into a contractual relationship on behalf of a third party must represent and warrant that they are acting for and on behalf of the Client in accordance with the assignment and/or agency agreement, and that they have the legal authority to bind the Client contractually for all intents and purposes.

The term “user” covers exclusively the effects and rights recognized under consumer and user protection legislation, in the case of natural persons acting for purposes other than their trade, business, craft or profession,

Failure to accept these terms and conditions will prevent the use of the services offered by Inples.

 

Description of services

Description of Services
The intellectual property registration service may include one or more of the following services:

  1. Recording and annotating statements of ownership and/or authorship in Inples’ databases and computer systems. Inples’ electronic intellectual property registry operates as a repository that stores reliable evidence of the above, as well as the content and details of the work to prove authorship and rights. The aforementioned reliability and integrity of the information so claimed and stored is ensured through the use of public key technology and infrastructures, which include the generation of redundant cryptographic fingerprints to identify the work, as well as time stamping to record and confirm the date of registration and subsequent annotations with a record on the Ethereum blockchain.
  2. Recording and publishing the terms of licensing, use and exploitation of intellectual property rights associated with registered content or works. The user may define the conditions under which reproduction rights, public disclosure, distribution and other rights to use their works are authorized, to facilitate self-management of said rights or information provided to third parties.
  3. Issuance of electronic registration certificates of authorship, ownership, rights and conditions of licensing, use and exploitation of any registered works so that they can be produced, if necessary, as documentary evidence of said information and of the date and time of registration in Inples.

 

Access and use of the site

The User accesses the Site to obtain information about our services, activities and contact information. Access to and use of the Site is free of charge for Users and does not require prior registration of the User.
In the case of User registration through identifiers and passwords, both the identifier and password belong exclusively to the person to whom they are provided. User shall hold both the identifier and password in the strictest and absolute confidence and shall therefore bear all damages or consequences of any kind arising from the breach or disclosure of such information.

The User agrees to make proper, fair and lawful use of the Site and in particular:

  1. use the Site for its intended purpose, i.e. information services and activities, the User will refrain from using the Site. or its content for illegal purposes or for purposes contrary to public order, morality or generally accepted moral standards;
  2. respect the intellectual and industrial property rights in the Site and its content, as well as all rights corresponding to Inples;
  3. not reproduce, copy, transform, modify, distribute, publicly display or make publicly available the Site or any of its content or any modifications thereto;
  4. Users shall be liable for any loss or damage incurred by Inples as a result of direct or indirect misuse of the Site by Users.

 

User responsibilities

  1. The Client or User must be over 18 years of age and have full legal capacity to enter into a contractual relationship in accordance with the laws applicable to them. Otherwise, they must provide specific authorization from a legal representative to use Inples’ services in accordance with the provisions set forth herein. In the case of legal entities, the Client represents and warrants that they have been legally incorporated, duly registered and/or are acting in public registries, agencies and organizations within the scope of their activities and are in compliance with all their obligations.
  2. The User warrants that all information provided, including any attachments or files, if applicable, is true, accurate, complete, current and lawful. Creating an account with false or outdated information or information relating to third parties, or in particular that violates intellectual property or data protection rights, or the right to freedom from harm to honor and self-esteem, privacy or confidentiality, or with information that constitutes a crime entails a serious breach or violation of these terms and conditions. Inples reserves the right to suspend, block or delete accounts that infringe brands, trade names or other distinctive logos, and those that use names or pseudonyms belonging to third parties without authorization, are illegal, offensive or harmful.
  3. User shall receive and respond to any notices or communications sent by Safe Creative regarding possible infringement of third party intellectual property rights, outdated or inaccurate data provided by User, and incidents arising from the use of Inples services, and agrees to respond to such communications in a timely manner.

 

Duties of Inples

  1. Inples hosts and protects the files deposited through this service and undertakes not to use them in any way other than in the cases provided for in these legal terms and conditions, unless the authors/rights holders have explicitly agreed otherwise. He shall maintain said files in the same condition in which they have been entrusted to him, ensuring that unauthorized third parties cannot access them.
  2. Exceptions to the provisions set forth in the preceding paragraph are injunctions and final orders issued by competent administrative or judicial authorities as part of an investigation or judicial proceeding of which irrefutable notice has been received.
  3. At the request of Users who have a Professional or Business subscription, Inples undertakes to certify to third parties the content of their registration record under the conditions under which they were registered and claimed, and to provide the information specified by the User.
  4. By exception, Inples reserves the right to block, suspend or terminate access to any content or services that may be deemed fraudulent, illegal or contrary to the provisions set forth herein, and to take any legal action it deems appropriate. to protect its interests or the interests of the persons it represents.

 

Terms of payment

Inples offers certain limited services for free as well as paid services. The registry subscription methods and prices are listed on the rates page and may be updated periodically.

Payment methods specifically stated at the time of purchase are allowed. Inples does not under any circumstances have access to account details, card number or other payment methods entered on the platform, which are processed through a third party virtual gateway that uses encrypted messages, thereby preventing the interception of data transmitted in accordance with the usual protocols and security requirements established by applicable law for payment service providers or intermediaries.

In the event of a breach of any of the payment obligations set forth herein, the breaching party shall automatically be deemed to be in default without the need for the creditor to give prior notice of payment, and the former shall be obliged to pay the amounts due plus interest. at the lawful interest rate established on an annual basis.

Failure to pay any amount will also result in immediate termination of access to the service. Said access will be restored as soon as the amounts due, together with applicable interest and fees, have been paid.
If the purchase amount has been charged fraudulently or improperly using the payment card number, the consumer and the cardholder may request immediate reversal of the payment.

 

Intellectual property rights

The Inples name and logo are protected by trademarks. Inples exclusively owns all intellectual property rights granted by applicable law.
Likewise, the design of the whole Website and all its contents (text, news, articles, graphics, logos, drawings, photos, software, source code, etc.) are the exclusive property of Inples. Consequently, all intellectual property rights derived from them belong to Inples in full (i.e. for the full legal term of such rights, worldwide and for all and any form of exploitation) or, alternatively, when properly licensed for use. by its rightful owners. The use (reproduction, distribution, communication to the public, communication to the public and/or transformation, including translation) of the content of the Site, which is an object of intellectual property, by any means whatsoever is strictly prohibited without the prior written authorization of Inples.

Enforcement and jurisdiction

This Site, its Legal Notice and its Terms of Use shall be governed by the Thai laws applicable thereto. User hereby expressly agrees that any conflict or dispute arising in connection with this Site, its Legal Notice and its Terms of Use shall be brought exclusively in the ordinary courts of Phuket, Kingdom of Thailand, irrespective of any other jurisdiction or court to which the Parties may apply, having the right to submit such conflict.
